FTC and CFPB Set Sights on Employment Relationships and Labor Markets

The Federal Trade Commission and Consumer Financial Protection Bureau, the country's consumer watchdogs, have broadened their missions to include protecting workers and labor markets. Over the last 18 months, the agencies have taken several measures toward that goal, including entering into a memorandum of understanding with the National Labor Relations Board, engaging in rulemaking regarding claims employers can make about earnings, scrutinizing mergers they believe are harmful to the labor market, issuing a request for information on employer-driven debt and whether it should be regulated as a financial product, scrutinizing noncomplete clauses in employment contracts, and bringing enforcement actions against companies that made deceptive statements to prospective employees.
