From Clear and Conspicuous to Unavoidable? The FTC’s Updated Endorsement and Testimonial Guides

This event has already occurred.

Join us on August 2, 2023 for a webinar highlighting the key changes and revisions to the Federal Trade Commission's Endorsements and Testimonial Guides (Guides) and a discussion of the Commission's new proposed trade regulation: "Rule on the Use of Consumer Reviews and Testimonials." Find out what your company can do to avoid being caught in the FTC's crosshairs before it's too late, because increased scrutiny is no longer on the horizon—it has arrived.

The Guides and the proposed rule indicate that influencers and endorsers are on the FTC's radar. Not updated since 2009, the Guides now feature an expanded definition of "endorsers" and clarify that tags and "likes" may constitute "endorsements." They also make it clear that intermediaries such as ad agencies, public relations firm, review brokers, and reputation management companies may face liability for helping to create ads that contain deceptive endorsements.

This 90-minute webinar will also address:

  • the new definition of "clear and conspicuous" in the disclosure context
  • purchasing "likes"
  • reformulated products
  • customer reviews
  • review sites
  • employee endorsements
  • endorsements aimed at kids

The new Guides consist of more than 80 pages of analysis, revisions, and examples. Let us help you sift through them and find out what your company can do to avoid penalties.
