Venable partner and chair of the Advertising and Marketing Group Len Gordon served as a panelist on "Proposed Negative Option Rules Not a Positive for Performance Marketers” at the PDMI West Conference, hosted by the Performance-Driven Marketing Institute on October 11, 2023 in San Diego, California.
Presented by the E-Commerce Council, this session provided an update on the Federal Trade Commission's (FTC) proposed tightened requirements for the Negative Option Rule, which are intended to combat unfair or deceptive practices, such as recurring charges for products or services that consumers do not want and cannot cancel without undue difficulty. According to the FTC, the "patchwork of laws and regulations does not provide industry and consumers with a consistent legal framework across media and offers."
