Venable is a proud sponsor of the Colorado Bar Association Rocky Mountain Intellectual Property & Technology Law Institute on May 28-29, where partners Emily Keimig, Philip Sheng, and Manny Caixeiro will be speaking.
Emily and Philip will lead a discussion on trademarks and copyrights titled “NIL and Rights of Publicity Update.” The session will provide an update on the evolving landscape of name, image, and likeness (NIL) rights and the broader right of publicity. It will explore emerging legal issues surrounding AI-generated actors and digital replicas, as well as recent developments in sports and entertainment law. The discussion will also address how publicity rights apply in modern contexts such as memes and viral content, where ownership and consent can be unclear. In addition, the session will cover ongoing changes affecting NCAA athletes, including NIL compensation and regulatory developments shaping their rights and opportunities.
Manny’s session, “Navigating Global Trends in SEPs and FRAND Licensing,” will explore the evolving global landscape of standards-essential patents (SEPs) and fair, reasonable, and non-discriminatory (FRAND) licensing. It will examine recent court decisions shaping how FRAND terms are interpreted and applied across jurisdictions, highlighting key trends and divergences in judicial approaches. The discussion will also cover portfolio licensing practices, including how SEP portfolios are valued and negotiated in complex, multi-party environments. In addition, the session will address strategic considerations in international disputes, such as jurisdiction selection and the use of anti-suit injunctions, offering practical insights into navigating cross-border SEP litigation and enforcement.
