Philip Sheng is a litigator who represents clients in complex and must-win intellectual property disputes. He has represented clients before the U.S. International Trade Commission (USITC), in federal and state courts, and in litigation in the UK, Germany, and the Unified Patent Court (UPC). Philip has experience in matters related to life sciences and pharmaceuticals, telecommunications, content streaming, semiconductor integrated circuits, and related technologies.
Earlier in his career, Philip served as a law clerk to Chief Judge Randall R. Rader of the U.S. Court of Appeals for the Federal Circuit, which has exclusive, nationwide appellate jurisdiction over cases arising under the patent laws.
Represented a multinational telecommunications and media conglomerate and its subsidiaries in a patent infringement case in the International Trade Commission involving patents related to video-on-demand technology. After obtaining a favorable claim-construction ruling for the client, the patent holder withdrew its allegations, which led to the termination of the investigation by the Commission
Served as lead trial counsel for a medical technology company in a patent infringement lawsuit against its sole competitor, securing for the client a verdict of infringement and over $2M in damages
Represented a healthcare technology and services company against trade secret misappropriation claims brought after the client hired an executive from a competing healthcare company. After successfully defending against a preliminary injunction motion, the case settled favorably for the client
Served as lead trial counsel defending a multinational telecommunications and media conglomerate and its subsidiaries in multiple patent litigations initiated by a digital entertainment technology company. Dozens of patents were asserted in United States District Courts and the International Trade Commission. After four-plus years of litigation, the parties reached a global business resolution
Represented a trio of semiconductor companies, including the world’s leading semiconductor manufacturing and design company, in the International Trade Commission in a patent case brought by a patent acquisition, management, and licensing company. After strong showings of non-infringement or invalidity for each of the asserted patents, the case resolved favorably for the clients early in the litigation
