Josh Druckerman assists clients with the acquisition, use, sharing, and protection of valuable data. Josh's understanding of technology, particularly as it relates to data processing and privacy, enables him to work seamlessly with IT, compliance, marketing, and product teams to understand their needs, identify risks, and develop and implement creative solutions to the challenges posed by modern business initiatives and privacy regulations. Josh also counsels clients in diverse industries on compliance with privacy, data protection, advertising, and consumer protection laws, requirements, and self-regulatory regimes; U.S. and international statutes; and platform requirements.

A skilled transactional lawyer, Josh has drafted and negotiated countless data and software license agreements, IT service provider engagements, consulting agreements, and other contracts that touch on privacy, data security, and technology. He helps clients proactively identify and address data security risks and advises them on responding to security incidents and data breaches.

Josh's capabilities include:

  • Drafting, negotiating, and advising on the privacy, confidentiality, and data security aspects of vendor and service provider engagements, data licensing, IT outsourcing, software-as-a-service (SaaS), and corporate acquisitions
  • Counseling on the collection, use, sharing, and monetization of data in compliance with applicable laws, license terms, and industry and platform requirements
  • Conducting privacy assessments for existing and proposed products and business initiatives, including in the context of mergers and acquisitions
  • Developing, drafting, and implementing tailored privacy, data security, and data protection policies, disclosures, and compliance programs

Josh advises clients on matters arising under a range of U.S. and international legal regimes, including the California Consumer Privacy Act of 2018 (CCPA), the General Data Protection Regulation (GDPR), the Gramm-Leach-Bliley Act (GLBA), the Telephone Consumer Protection Act (TCPA ), the Fair Credit Reporting Act (FCRA), and federal and state laws that prohibit unfair or deceptive business practices. He also advises on various state and local privacy, cybersecurity, and data breach notification laws.

Josh is a Certified Information Privacy Professional (CIPP/US) accredited by the International Association of Privacy Professionals.
