Arie Peled

Arie Peled focuses on complex litigation, within and outside of the bankruptcy context. He frequently works on commercial mortgage-backed securities (CMBS) issues—assisting trusts and special servicers on foreclosure and guaranty actions, receiverships, intercreditor disputes, single-asset real estate bankruptcies, and workouts, modifications, and sales of CMBS loans. Arie also represents creditors in all aspects of the Chapter 11 process and has experience litigating Chapter 15 issues as well.

Representative Matters

  • Represented various commercial mortgage-backed securities (CMBS) trusts in successfully foreclosing on properties securing commercial mortgage loans ranging from tens of millions to hundreds of millions of dollars. In several of these cases, the firm successfully petitioned and was granted the appointment of a receiver to manage the property at issue, while the foreclosure action was pending
  • Represented a significant customer in connection with the Celsius bankruptcy in New York. The Venable team successfully obtained reimbursement from the Celsius bankruptcy estate for a significant portion of the client’s legal fees due to what the Bankruptcy Court deemed Venable's "invaluable" contribution to uncovering the full scope of Celsius' fraudulent conduct and moving the bankruptcy cases toward a confirmed Chapter 11 plan
  • Represented a U.S. fund and its affiliates as unsecured creditors in a Chapter 15 application requesting the recognition of a Cayman Islands insolvency proceeding brought by a drillship company and its affiliates
  • Assisted the foreign representative of an insolvent Swiss company on issues related to its Chapter 15 filings and represented the client in bankruptcy litigation against counterparties arising from the close-out of more than $100 million in derivatives contracts
  • Represented foreign high-net-worth individuals in an SEC enforcement action alleging violations of U.S. securities regulations and seeking tens of millions of dollars in disgorgement, monetary penalties, and injunctive relief. After successfully dismissing the SEC's initial complaint, team obtained a favorable settlement
