We draft, review, and negotiate virtually every type of construction agreement, emphasizing risk mitigation through the agreement terms and the key development milestones for each solar project.

Land Use, Permitting, and Zoning

Building on our strong relationships with local, state, and federal governments, our land use attorneys help clients secure approvals and expedite the completion of projects throughout the country. We combine legislative, administrative, and regulatory knowledge to help clients secure special permits, zoning variances, authorizations and certifications, and other approvals and entitlements.

Environmental

Drawing from our vast experience navigating federal, state, and local environmental laws, we recognize that such regulations can significantly delay projects or prevent them from getting off the ground. Our attorneys manage land use and environmental reviews under the National Environmental Policy Act (NEPA) and related state regulations, like the California Environmental Quality Act (CEQA) and New York State Environmental Quality Review Act (SEQRA), as well as federal and state special-purpose laws related to species, historic properties, and other resources. Many of our environmental lawyers have deep experience with renewable energy projects. We also complete environmental due diligence, including with respect to renewable development projects on historically contaminated land.

Tax

Our attorneys are attuned to the latest changes in federal and state solar energy financial incentives and tax exemptions, including recent changes under the One Big Beautiful Bill Act of 2025. We regularly advise on project finance and tax structuring, representing tax credit investors, syndicators, community development entities, borrowers, lenders, and developers in all aspects of tax credit financing transactions.

  • Representing a large landowner in the Pacific Northwest to negotiate a large-scale solar lease, including joint development rights
  • Representing a large property owner on a program to lease rooftops for solar development across its portfolios
  • Representing a contractor on EPC agreements and structuring to build solar projects across owned portfolios
  • Representing multiple solar developers on safe harboring strategies
  • Represented a large agribusiness in negotiations with a solar power project developer, resulting in one of the then-largest commercially owned solar power systems in the Eastern United States
  • Negotiated a power purchase agreement (PPA) and lease agreement associated with a solar power installation at a professional sports franchise's practice facility
  • Defended utility-scale solar energy developments on federal and state land
  • Represented a bank in the development of its financing efforts to fund solar projects
