Infrastructure

Venable helps clients navigate the environmental review and permitting process for complex infrastructure projects, from conception through litigation, across all sectors, and around the United States.

Our attorneys work with clients to expedite the completion of some of the nation's most ambitious developments, including interstate bridges and highways, pipelines, water supply tunnels, mines, and spaceports. Partnering with public-private partnerships (P3) developers, government agencies, and environmental consultants, we help identify and resolve potential issues that arise during the approval process for all major infrastructure projects. We are adept at finding creative solutions to environmental or permitting issues. We represent clients from the development of a project — positioning them from the start to avoid legal challenges down the road — to the preparation of environmental impact statements and issuance of agency permits. In matters related to energy production, mineral extraction, onshore or offshore wind power developments, and surface transportation facilities, we advise from the planning and siting stages to ensure a sound and defensible administrative record.

With a team that includes the former chief counsel of the U.S. Federal Highway Administration, among other former government officials, we are deeply engaged in the development of environmental policy and regulations, including authoring legislation aimed at streamlining the National Environmental Policy Act (NEPA) and permitting processes. Our attorneys' positive relationships with key agency decision-makers in Washington, DC help resolve permitting challenges for even the most controversial project proposals. We routinely represent clients in disputes under the National Historic Preservation Act, the Endangered Species Act, and other federal natural resources permitting laws. While minimizing litigation threats that disrupt projects, our team helps produce comprehensive administrative records throughout the process. We successfully defend against any challenges that arise, from citizen suits to government enforcement actions or Administrative Procedure Act challenges. No matter how great the project scope or scale, Venable's infrastructure team has the skill and knowledge needed to bring our clients' vision to reality.
