The new federal Consumer Financial Protection Bureau (“CFPB” or “Bureau”) is focusing on advertising, marketing, and lead generation for consumer financial products and services.  The CFPB has regulatory, supervisory and enforcement jurisdiction over banks and nonbanks that offer or provide consumer financial services, including but not limited to student loans, mortgage servicing, auto lending, small dollar lending, consumer reporting, consumer credit and related services, money transmission and check cashing, prepaid cards, debt relief services.  The CFPB is coordinating its investigations and other enforcement actions with the federal banking agencies, the Federal Trade Commission (“FTC”), state Attorneys General, and state banking agencies. 

Since the CFPB’s launch, the Bureau has brought several high profile enforcement actions related to advertising and marketing practices.  The CFPB has investigations currently underway that span the full breadth of the Bureau’s enforcement jurisdiction, and is reviewing advertising and marketing during its supervisory examinations of banks and nonbanks. 

This webinar will discuss the effect of the CFPB’s supervisory, regulatory and enforcement power on advertisers and marketers, and their service providers, help you understand the CFPB’s expectations, and share experiences from two veteran attorneys that have been on the front lines.

  • The similarities and differences between the CFPB UDAAP (Consumer Financial Protection Act), FTC UDAP (FTC Act), and the federal banking agencies UDAP legal authorities (FTC Act and Regulation AA)

  • Case studies from notable CFPB enforcement actions and announcements


  • Compliance tips, including use of third-party service providers


  • Exam preparation and ways to navigate a CFPB investigation into advertising and marketing practices
