Michael J. Volpe


Mike Volpe is the Head of Venable's nationwide Labor & Employment practice group. Over the past 25+ years, Mike has represented domestic and international corporations with U.S. operations, including several Fortune 500 companies, in the healthcare, real estate, textile, private equity, retail, technology, manufacturing, theater and entertainment, nonprofit, education, and restaurant and hospitality industries, in all facets of employment litigation, labor law and employment counseling.


Private Equity: Mike advises private equity firms and their portfolio companies on all day to day labor and employment law issues including restrictive covenant advice and counsel on a fund and portfolio level.

Healthcare: Mike has represented numerous public and private hospitals and healthcare systems in collective bargaining negotiations and arbitrations before the NLRB and/or PERB. His healthcare experience extends to employment counseling and commercial litigation, and he achieved a defense verdict in a $10 million breach of contract case brought by a medical practice group against a hospital.

Hospitality: A trusted advisor to general counsel and general managers in the restaurant, hotel, and private club industry in New York and nationally, Mike advises clients on issues involving wage and hour and tipping provisions, labor relations, negotiating collective bargaining agreements and regularly provides HR training to clients.

Education & The Arts: Mike has defended several high profile and public lawsuits, including:

  • Caraballo, et al. v. Art Students League, et al. (dismissal of challenges to a NYC nonprofit entity consummating a real estate transaction that provided the client with $31.8 million from a real estate deal and development on a neighboring property)
  • Gomez-Jiminez, et al. v. New York Law School, et al. (dismissal of tort and fraud claims brought by nine graduates of New York Law School who accused their alma mater of misleading them about their postgraduate employment prospects)
  • Casey, et al. v. Florida Coastal School of Law, et al. (defense of putative class action against university stemming from the reporting of detailed post-graduate information)
  • Cooper v. The Trustees of the College of the Holy Cross, et al. (successful defense of college and several of its administrators in a federal action alleging misconduct in the college‚Äôs athletics department.)


Labor Relations & Labor Law: He regularly handles labor relations issues unique to mergers and acquisitions and in bankruptcy situations, he represents clients in contract administration and he has represented clients in many arbitration and mediation proceedings. He routinely represents public and private employers in labor matters ranging from union organizing issues and related proceedings before the NLRB and/or PERB to collective bargaining and complex, "first contract" labor negotiations. He provides training to employers on union organization.

Employment Law & Wage-Hour Litigation: Litigating on behalf of employers before administrative agencies and in federal and state courts. He has extensive jury trial experience in defending all types of employment related claims under federal, state and local laws. His practice also includes the defense of wage-hour class actions matters under federal and state laws.

Commercial, Business & Restrictive Covenant Litigation: Mike has represented clients defending claims of breach of contract, unfair business practices, unpaid sales commissions, violations of restrictive covenants, and various business tort claims. He has bench and jury trial experience in the commercial area and has handled a number of cases resulting in defense verdicts.


Mike is currently the Mayor of the Village of Pelham, New York. He previously served in the Town of Pelham as a Town Council member for 2 four-year terms and was the Deputy Mayor of the Village of Pelham.
