Emily Faro focuses her practice on advising brands, agencies, sports organizations, and entertainment companies on matters related to advertising and entertainment. Emily has experience helping clients navigate celebrity and influencer endorsements; social and digital media; artificial intelligence (AI); SAG-AFTRA requirements; name, image, and likeness (NIL) engagements; Federal Trade Commission (FTC) compliance; and intellectual property (IP) issues. She also drafts and negotiates talent and production agreements, sponsorships, promotions, and other commercial arrangements that support clients' marketing initiatives. Emily draws on her industry knowledge as she helps clients move campaigns and productions forward efficiently while managing legal and reputational risk.

Emily counsels on and negotiates advertising and entertainment matters, from campaign concept through production and launch, including scripts, commercial cuts, talent rights, claims substantiation, and related advertising and entertainment issues. She drafts and negotiates celebrity and talent endorsement deals; influencer agreements and programs; advertising and media agency agreements; production services and vendor agreements; and sponsorship, promotions, and licensing arrangements. She works with creative teams, production companies, agencies, talent representatives, and other counterparties under compressed production and campaign timelines and has advised on commercial issues affecting the industry, bringing a practical, deal-focused perspective.

Emily also focuses on promotions counseling and claims substantiation, providing legal review of marketing programs and drafting rules for sweepstakes, contests, prize promotions, and other consumer-based promotions. She advises clients on false advertising risk and promotional incentives, as well as commercial co-ventures, charitable sales promotions, loyalty programs, and social media compliance. Emily provides day-to-day advertising review and clearance guidance, helping marketing and legal teams build compliant campaigns from concept through distribution.

Emily serves as legal counsel to the Joint Policy Committee (JPC), the bargaining representative for the advertising industry in negotiations over the SAG-AFTRA Commercials Contracts, advising on SAG-AFTRA, production, and commercial issues affecting the advertising industry.

Emily also counsels clients on evolving issues involving AI, emerging technology, and digital talent.
