He regularly defends clients in investigations before congressional committees and the Federal Trade Commission (FTC), among other regulatory bodies. Brian also advocates on behalf of clients before federal policymakers, promoting legislative and regulatory approaches that preserve responsible uses of data critical to our economy.

As companies in virtually every industry find new ways to collect and analyze customer data, and regulators continually develop new guidance with increased scrutiny, Brian makes sure his clients realize their legal obligations in protecting valuable and sensitive customer information. He keeps clients informed of the rapidly changing legal landscape and proactively ensures that they understand the steps that are necessary to remain compliant with all federal, state, and international laws regulating data use and privacy. These include the California Consumer Privacy Act (CCPA) and similar omnibus state privacy laws, the General Data Protection Regulation (GDPR), the Fair Credit Reporting Act (FCRA), the Health Insurance Portability and Accountability Act (HIPAA), the Gramm-Leach-Bliley Act (GLBA), and state data breach notification laws.

Through his engagement with federal policymakers and his work counseling a major industry trade association, Brian helps to ensure that any new laws and regulations recognize the benefits of the data services his clients provide. This advocacy not only enables Brian to protect and advance clients’ interests during the policymaking process. It also enables him to anticipate forthcoming policy developments so he can better advise clients on legal compliance.
